as data controllers (collectively "we"), are committed to correctly processing the personal data of passengers ("your data").

Why, when and how to collect your personal data

The following are the main purposes for which your data are processed.

When you write us a message using the "Contact Us" page, and express your will to receive personalized information

about our products and services by clicking on the consent box, we will contact you by e-mail or SMS

or by phone to let you know our latest offers and products that we believe may interest you. In the same way,

it is possible to provide informed and specific consent to receive personalized information from us when you sign up for our newsletter,

or when a brochure or a call is requested. In all the above cases, it is not mandatory to provide consent to receive messages

and personalized offers from us, but without consent we will not be able to send personalized offers.

Since the processing of data for the above purposes is based on the specific consent of the data subject (article 6.1 (a) GDPR),

For how long we keep the data

Pursuant to Article 5.1 (e) GDPR, personal data are stored in a form that allows identification of data subjects

and, in any case, for a period not exceeding that specified by the applicable laws.

We have defined a Corporate Data Retention Policy that specifies the period for processing data,

after which all copies of personal data are destroyed or made anonymous using appropriate techniques

that do not allow the subsequent identification of the data subject.

Categories of recipients of data and transfer of personal data

a.a. Company of our group
Depending on the country from which the request was made, and to provide specific services, we share information

of the data subject with the companies of our Group. All companies process personal data in accordance with the GDPR.

The personal data of users in the EU are not generally shared with the companies of our Group that are located outside of Europe.

However, in the event that the data must be transferred to a non-EU / EEA country, EMERSON MACCHINE S.r.l.

will take safeguard measures to ensure that the transfer takes place in compliance with applicable privacy legislation,

in particular the provisions of the GDPR.

Rights of the interested party

The GDPR provides for a strengthening of rights and EMERSON MACCHINE S.r.l.

undertakes to provide adequate control of your personal data.

In particular, the following rights are recognized in relation to personal data:

a. The right to access personal data and obtain specific information on how we handle it, in accordance with Article 15 of the GDPR;

to fulfill a legal obligation that requires treatment by the law of the Union or the Member State to which EMERSON MACCHINE S.r.l.

is subject to or for the performance of a task performed in the public interest or in the exercise of public authority

conferred on the Data Processor; for reasons of public interest in the field of public

health in accordance with points (h) and (i) of Article 9.2 and Article 9.3 of the GDPR;

or for the establishment, exercise or defense of legal claims.
 

d. The right to limit the processing of personal data. Under Article 18 of the GDPR,

this right can be exercised in the following cases:
Temporary restriction, in which the accuracy of personal data is contested; in this case,

we will limit the processing of your data for a period that will allow us to verify the accuracy

of such data and provide feedback on the revocation of the limitation;

The processing is illegal and the interested party opposes the cancellation of personal data,

asking instead that its use is limited;

Although EMERSON MACCHINE S.r.l. it no longer needs it for processing purposes,

but personal data are necessary for the person concerned to ascertain, exercise or defend a right in court;

In the event that the interested party has opposed the treatment pursuant to Article 21, paragraph 1,

the processing is limited pending verification of the possible prevalence of the legitimate reasons

it is possible to exercise this right in cases where the treatment is based on the consent

of the interested party or on the contractual relationship with EMERSON MACCHINE S.r.l.

or with one of the companies in our Group, and the processing is done by automated means.
 

a.f. The right to object, at any time, to the processing of personal data. Under Article 21 of the GDPR,

the data subject may exercise this right when the processing is based on the performance

of a task performed in the public interest or in the exercise of an official authority attributed to us,

or where the processing is based on our legitimate interests.
 

a.g. The data subject has the right not to be subjected to a decision based solely on automated processing,

including profiling, which produces legal effects concerning him or which significantly affects his person.

In compliance with article 22 of the GDPR, the interested party can exercise this right unless the treatment is necessary

to stipulate or execute a contract between the interested party and EMERSON MACCHINE S.r.l. or one of the companies in our Group;

or is authorized by the legislation of the Union or the Member State to which we are subject

and which also establishes appropriate measures to safeguard the rights and freedoms of the data subject and legitimate interests;

or if the treatment is based on the explicit consent of the interested party.
 

a,h. In the event that the interested party considers that the processing concerning him / her violates this Regulation,

in accordance with Article 77 GDPR, he has the right to lodge a complaint with a supervisory authority,

particularly in the Member State in which he normally resides , work or the place where the alleged violation occurred.
